Amongst numerous Labour related laws in India, Labour Law 1 Deals with FOUR Acts viz. Industrial Dispute Act 1947, Factories Act 1948, Trade Union Act 1926 and The Industrial Employment (Standing Orders) Act, 1946.
The Industrial Disputes Act, 1947 is one of the first labour legislations in India. It aims at peaceful, amicable and expeditious settlement of the industrial disputes for which it establishes various dispute resolution authorities. It also regulates the process of collective bargaining by way of providing for strikes and lockouts. In order to reduce the friction in the industry and to guarantee its smooth functioning, this act also enumerates Unfair Labour Practices and provide punishment for the same.
The Factories Act, 1948 is the oldest labour welfare legislation in India. It deals with the working conditions of the labours in the industry. This Act enumerates detailed provisions regarding Health, Safety and other working conditions of the labours. It also provides for the effective implementation of these provisions by appointing various authorities to enforce the provisions of this act.
The Trade Union Act, 1926 is a legislation which aims at the regularization of collective bargaining by providing for the establishment and registration of the Trade Union. It also provides for the rights and liabilities of the registered trade union to promote the registration of the same.
The arbitrariness of the employers in relation to the rules applicable in the industry has been dealt with by The Industrial Employment (Standing Orders) Act, 1946. It mandates the registration and proper publication of the standing orders applicable in an establishment so that the workers/employees have access to these rules and they can’t be misused by the employer.
