Course Overview


Tort law is the area of the law that covers most civil suits. Generally, every claim that arises in civil court, with the exception of contractual disputes, falls under tort law. The boundaries of tort law are defined by common law and state statutory law. The primary aims of tort law are to provide relief to injured parties for harms caused by others, to impose liability on parties responsible for the harm, and to deter others from committing harmful acts. Torts can shift the burden of loss from the injured party to the party who is at fault or better suited to bear the burden of the loss. Typically, a party seeking redress through tort law will ask for damages in the form of monetary compensation. Less common remedies include injunction and restitution. As this area of law has developed it has proved to be infinitely adaptable, but it has not developed in isolation. Other areas of law have evolved alongside tort.

There are numerous specific torts including trespass, assault, battery, negligence, products liability, and intentional infliction of emotional distress. There are also separate areas of tort law including nuisance, defamation, invasion of privacy, and a category of economic torts.

 


The Consumer Protection Act seeks to promote and protect the interest of consumers against deficiencies and defects in goods or services.It safeguards and encourages consumers to speak against insufficiency and flaws in goods and services.It also seeks to secure the rights of a consumer against unfair trade practices, which may be practiced by manufacturers and traders.

The Consumer Protection Act, 1986 was later amended in 2019. Therefore it is now called as the Consumer Protection Act,2019.


The Indian Parliament passed the Motor Vehicle Act in 1988. It helps regulate all the aspects of road transportation. It also has provisions for traffic safety regulations, motor insurance, vehicle registration, controlling permits, and penalties.

The Motor Vehicles (Amendment) Act 2019 has been implemented throughout the country since September 1, 2019. Now the penalty has been increased 10 times on various violations.

Savina Crasto is a highly experienced advocate, practicing for over 13 years with a specialization in Public Interest Litigations (PILs), Writs, Family, and Criminal matters. She currently serves as an Assistant Government Pleader at the Bombay High Court (Appellate Side, Writ Cell) and is the Managing Partner and Founder of M/s. Right & Rights, a law firm focusing on property-related matters, conveyancing, and more.

In addition to her legal practice, She is also a professor at LegalSikho, where she continues to guide students and professionals in the legal field. Savina has been an esteemed academician, serving as a visiting faculty at Government Law College, Churchgate, Hindi Vidya Prachar Samiti College of Law, and other reputed institutions. She has delivered guest lectures across various law colleges, sharing her expertise with aspiring legal professionals.

Savina has presented papers at numerous international conferences, including her work on “Cyber Bullying: Are the Existing Laws Acting as a Detriment” in Dubai and “Single Women and Social Security: A Struggle between Perception and Ambition” at K.C. Law College. Her paper on “Impact of Digitization with Special Reference to Gambling” was well-received at Russels Square International College.

Nationally, she has presented critical studies such as “Empowerment of Women through Judicial Reservations” at Osmania University, Hyderabad, and “Displacement and Deprivation of Human Rights of Tribals” at North Maharashtra University, Jalgaon. Her paper on “Protection of Intellectual Property as a Tool for Economic Development” has also been published and discussed at Dayanand College of Commerce, Latur.

With a strong academic foundation, Savina is pursuing her Ph.D. from Dr. Ambedkar College, Nagpur, and holds two LLM degrees in Human Rights and Intellectual Property Rights. Her contributions to legal education and research have been recognized both nationally and internationally.
